Terms of Use

These Terms govern your use of the mobile app Smiley Battle: Emoji Legends and all connected online services. By installing and using the app you accept these Terms.

1. Scope

These Terms govern your use of the mobile application Smiley Battle: Emoji Legends ("App") and all connected online services. The provider is Digitale Manufaktur Rudolstadt ("we", "us"). By installing and using the App you accept these Terms.

2. Subject of the Agreement

We provide the App free of charge via the Google Play Store. Optional in-app purchases are subject to Section 5.

3. License

We grant you a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial purposes. Reselling, leasing, redistributing or modifying the App, its assets or source code without our prior written consent is prohibited.

4. Accounts and Online Services

For online features (multiplayer, leaderboards, cloud save), an anonymous Firebase account is created. Linking with a Google Play account is optional. You are responsible for keeping your save data secure.

5. In-App Purchases and Virtual Currency

• All in-app purchases are processed via Google Play Billing. Google Play's terms apply.
• In-game currency (Coins) is not legal tender and cannot be exchanged for cash or other value.
• Purchases are final. Refunds are governed by Google Play's refund policy.

6. Code of Conduct

When using online features you agree not to:

• post offensive, discriminatory, racist, violent, or sexually explicit content (e.g. in player names, bios, messages);
• infringe third-party rights;
• use malware, bots, cheats, exploits, or any form of manipulation;
• harass other users;
• publish third parties' personal data.

Violations may result in account bans, content removal, and save-data resets - without entitlement to compensation.

7. Pre-Registration Reward

If you pre-registered through Google Play before the official launch, you will automatically receive the exclusive Launch VIP smiley (Rarity 7) and a bonus lootbox on first launch. The reward is delivered via Google Play Billing and expires if you do not open the App within 60 days of launch.

8. Availability and Changes

We strive for continuous availability of the App and its online services. You are not entitled to uninterrupted access. We reserve the right to modify, suspend, or discontinue features, content, prices, and mechanics at any time - in particular for maintenance, bug fixes, or further development.

9. Privacy

Processing of personal data is described in our Privacy Policy.

10. Liability

We are liable without limitation for intent and gross negligence as well as under the German Product Liability Act and for injury to life, body, or health. Otherwise liability is limited to foreseeable damages typical for this type of contract. In particular, we do not accept liability for lost save data, progress, or virtual items due to technical issues, account deletion, or force majeure.

11. Intellectual Property and Third-Party Content

The App and all texts, graphics, sounds, and code contained therein are protected by copyright. Third-party content (emoji graphics, sounds, fonts) is used under its respective licenses (Microsoft Fluent Emoji - MIT; Twemoji - CC BY 4.0; OpenMoji - CC BY-SA 4.0; Noto Emoji - Apache 2.0, among others). A detailed license overview is available in the App's settings menu and at smileybattle.com/credits.html.

12. Termination

You may terminate use at any time by uninstalling the App. We may terminate the agreement without notice for serious breaches of these Terms.

13. Changes to These Terms

We reserve the right to modify these Terms with effect for the future. Material changes will be announced in the App in good time. The current version is always available at smileybattle.com/nutzungsbedingungen.html.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction for merchants is Rudolstadt, Germany. Consumers may also sue at their place of residence.

15. Severability

If any provision of these Terms is or becomes invalid, the remaining provisions remain unaffected. The invalid provision shall be replaced by the statutory rule.
